Business Terms of Use

1. Parties

This Terms of Use ("Agreement") takes effect between TomrisBT Bilişim ve Teknoloji Hizmetleri ("mytrend.ai" or "Company") and the individual/entity ("User") registering a "Business" account on the mytrend.ai platform, once accepted electronically at registration.

2. Scope of Service

The Company provides the User with a published business profile, AI visibility measurement and improvement recommendations across AI engines (ChatGPT, Gemini, Perplexity, etc.), Schema.org/GEO optimization tools, and query/credit entitlements depending on the selected plan. The scope of the service may change based on the plan selected and features currently published on the platform.

3. User Obligations

• The User is responsible for the accuracy and currency of the business information entered on the platform (name, address, contact details, opening hours, etc.).
• The User may not use the platform to publish misleading, unlawful, or unethical content.
• The User is responsible for the confidentiality of account credentials and for all activity conducted through the account.

4. Pricing and Payment

Purchases of paid plans/credits are additionally governed by the Distance Sales Agreement. For Users on a free plan, this clause applies once a paid plan is purchased in the future.

5. Intellectual Property

The mytrend.ai brand, platform, software, and all related intellectual property rights belong to the Company. This Agreement grants the User only the right to use the platform for its intended purpose and does not constitute a transfer or license of any kind. Rights to the business content (text, images, etc.) uploaded by the User remain with the User; the User grants the Company a limited license to use that content on the platform and in queries sent to AI engines.

6. Limitation of Liability

The Company does not guarantee uninterrupted or error-free operation of the platform, nor the accuracy of responses generated by third-party AI engines (ChatGPT, Gemini, Perplexity, etc.). The Company shall not be liable for any indirect damages (loss of profit, data loss, reputational harm, etc.). The Company's total liability, if any, is limited to the total fees paid by the User in the preceding 12 (twelve) months.

7. Termination and Suspension

The User may close their account at any time. The Company reserves the right to suspend or close an account, with or without prior notice, if it detects use in violation of this Agreement or applicable law.

8. Personal Data Protection

Details on the processing of the User's personal data are set out in the KVKK Disclosure Text and the Privacy Policy.

9. Dispute Resolution

Disputes arising from the application of this Agreement fall under the jurisdiction of the Courts and Enforcement Offices of Antalya, Türkiye.

10. Effectiveness

By checking the "I accept the Terms" box on the registration form, the User declares that they have read and accepted this Agreement.
